Gram3D Terms of Service
Last updated: October 27, 2026
These Terms of Service ("Terms") are a legal agreement between Gram3D LLC, a Florida limited liability company ("Gram3D," "we," "us," or "our") and the person or entity using the Gram3D service ("you" or "Customer"). By creating an account, accessing, or using Gram3D (the "Service"), you agree to these Terms. If you are using the Service on behalf of a company, you represent that you have authority to bind that company, and "you" means that company.
If you do not agree to these Terms, do not use the Service.
1. What Gram3D Is
Gram3D turns a property survey/site plan and photographs into a to-scale 3D house model, exported as a standard FBX file for use in Realtime Landscaping Architect or other FBX-compatible software. The Service includes automated and reviewer-assisted processing of content you upload, a review/editing interface, a materials library, and export tools.
2. Accounts
- You must provide accurate information when creating an account and keep your login credentials confidential. You're responsible for all activity under your account.
- Accounts are for business/professional use by landscape design, build, or related firms and their staff — not for personal consumer use.
- You must be at least 18 years old to create an account. The Service is not directed to, and we do not knowingly collect information from, children under 13.
- Notify us promptly at support@gram3dlabs.com if you suspect unauthorized account access.
3. Your Content
"Customer Content" means the surveys, site plans, photographs, addresses, and any other material you upload, plus the specs, models, materials, and exports Gram3D generates from it for your account.
- You own your Customer Content. We don't claim ownership of it.
- You grant us a license to host, process, reproduce, and display Customer Content solely to provide and improve the Service to you (generating models, running the review editor, storing exports, customer support). This license ends when the content is deleted, except for backup copies retained for a reasonable period consistent with our data retention practices.
- You're responsible for having the rights to upload what you upload. If you upload a survey, site plan, or photographs of a property, you represent that you (or your firm) have the legal right to do so — for example, as the property owner's contracted landscape designer/builder, or with the owner's permission. Gram3D is not a party to, and has no visibility into, the relationship between you and the property owner.
- Shared materials library. If you opt in to contributing to a shared, cross-customer materials library (a feature that may become available separately from your own account's private library), any material you contribute will have customer-identifying information (like street addresses) stripped before being shared, and will become available to other Gram3D customers. You can decline this; it is off by default.
4. Acceptable Use
You agree not to:
- Upload content you don't have the right to upload, or that infringes someone else's intellectual property or privacy rights.
- Use the Service to build models of properties for any unlawful purpose, or in a way that violates another person's privacy.
- Attempt to reverse-engineer, scrape, or extract the underlying models, source code, or training data behind the Service, beyond what you're entitled to under these Terms.
- Share your account credentials, resell access to the Service without our written agreement, or use the Service to build a competing product.
- Upload malware, attempt to gain unauthorized access to our systems, or interfere with the Service's normal operation (including excessive automated requests beyond normal use).
- Use the Service in a way that violates any applicable law, including export control laws.
We may suspend or terminate access for a violation of this section, with notice where practical.
5. AI and Automated Processing
Gram3D uses automated systems, including large language models and image-generation models operated by third-party providers, to read your uploaded surveys/photos and to generate assistance such as draft material textures. See our Privacy Policy for which providers we use and what's sent to them.
- The output of this automated reading (the draft 3D model, measurements, and material assignments) is a starting point for your own review, not a certified survey or engineering deliverable. You are responsible for reviewing the model in the review editor and confirming its accuracy before relying on it or exporting it for client-facing use.
- We do not use your Customer Content to train general-purpose AI models for use outside your account, and we do not sell your Customer Content to third parties. If this ever changes for a specific, optional feature — for example, a future opt-in program to improve material-matching using anonymized, de-identified data across customers — we'll ask for your separate, affirmative consent first, not bundle it into these Terms by default.
6. Fees and Payment
- Plans and usage. Gram3D offers subscription plans, billed monthly, each including a set number of house models per month, shown on our pricing page. An active subscription is required to use the Service. Your account's usable house-model allowance is shown in your account dashboard. A subscription's included allowance applies to that billing period and doesn't carry over or accumulate month to month; additional house models beyond your plan's allowance are billed at the per-house overage rate shown for your plan.
- Billing and auto-renewal. Subscriptions are billed in advance each month and renew automatically until canceled. Payment is processed by Stripe, Inc.; we don't store your full card number ourselves. By subscribing or making a purchase, you authorize us to charge your payment method for the applicable fees, including future renewals.
- Canceling. You can cancel a subscription at any time from your account's billing page, which opens Stripe's own billing portal. Cancellation takes effect at the end of your current billing period — you keep access and your plan's remaining allowance through that period, with no partial-month refund for the time remaining.
- Failed payment. If a renewal payment fails, we (through Stripe) will attempt to collect payment again; your account's subscription status will show as past due while that's pending. If payment continues to fail, your subscription may be canceled and your plan downgraded to no active subscription. This doesn't delete your jobs or account — see Section 12 ("Term and Termination") for what happens to your data if your account is later closed.
- Refunds. We don't offer refunds for partial billing periods or unused plan allowance. If you believe you were charged in error, contact support@gram3dlabs.com and we'll look into it.
- Taxes. Fees shown don't include applicable sales, use, or similar taxes; where required by law, we (via Stripe) will add them to your invoice.
- Price changes. We'll give notice before any change to your plan's price takes effect, consistent with Section 13 below — a price change applies starting your next billing cycle after that notice, not retroactively.
7. Intellectual Property
Gram3D and its licensors own all right, title, and interest in the Service itself — the software, the pipeline, the website, our trademarks (including the Gram3D name and logo), and any improvements we make — apart from your Customer Content. These Terms don't grant you any rights to our intellectual property except the limited right to use the Service as intended.
8. Third-Party Services
The Service relies on third-party infrastructure and AI providers (see the Privacy Policy for the current list) to operate. We select these providers carefully, but we don't control their services and aren't responsible for their outages or independent acts or omissions.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT GENERATED MODELS WILL BE ERROR-FREE, DIMENSIONALLY PERFECT, OR SUITABLE FOR ANY PARTICULAR PROJECT WITHOUT YOUR OWN REVIEW. YOU ARE SOLELY RESPONSIBLE FOR VERIFYING MODEL ACCURACY BEFORE RELYING ON IT.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE/DATA, ARISING FROM THESE TERMS OR THE SERVICE; AND (B) GRAM3D'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE (OR $100 IF YOU HAVEN'T PAID US ANYTHING). Some jurisdictions don't allow these limitations, so some of them may not apply to you.
11. Indemnification
You agree to indemnify and hold Gram3D harmless from claims, damages, and reasonable legal fees arising from: (a) your Customer Content (including a claim that you didn't have the right to upload it), (b) your use of the Service in violation of these Terms, or (c) your violation of any law or a third party's rights.
12. Term and Termination
- These Terms apply from your first use of the Service until your account is closed.
- You may close your account at any time; see the Privacy Policy for what happens to your data afterward.
- We may suspend or terminate your access for a material breach of these Terms that you don't cure within a reasonable time after notice, or immediately for severe violations (e.g., unlawful content, security threats).
- Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability, indemnification, governing law) survive.
13. Changes to the Service or These Terms
We may update the Service and these Terms over time. For material changes to the Terms, we'll give notice (e.g., email or an in-app notice) before they take effect. Continued use after the effective date means you accept the updated Terms.
14. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. The state and federal courts located in St. Johns County, Florida have exclusive jurisdiction over any dispute arising from these Terms or the Service, and you consent to that jurisdiction and venue.
15. Miscellaneous
- Entire agreement: these Terms (with the Privacy Policy) are the entire agreement between you and Gram3D regarding the Service, superseding prior agreements on the same subject.
- Severability: if any provision is found unenforceable, the rest remains in effect.
- No waiver: failing to enforce a provision isn't a waiver of it.
- Assignment: you may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
